Terms

These terms are the agreement between you and Tinbird Labs (“Tinbird”, “we”, “us”) when you open a shop on Tinbird. By creating an account, you agree to them. How we handle personal information is covered in our privacy policy.
Your account
- You must be 18 or over to open a shop.
- Give us accurate information and keep your email address up to date. It’s how we reach you about your shop.
- Keep your sign-in details to yourself. You are responsible for what happens in your account.
- If you open a shop for a business, you confirm you can agree to these terms on its behalf.
Your shop and handle
Your shop lives at tinbird.shop/handle. We may refuse, change or take back a handle, for example one that impersonates someone, infringes a trademark, is abusive or is needed for Tinbird’s own pages.
What you can sell
Sell things you have the right to sell, and describe them honestly. You may not use Tinbird to sell or promote anything that:
- is illegal where you or your customers are;
- is counterfeit, or infringes someone else’s copyright, trademark or other rights;
- promotes hatred, violence or the exploitation of anyone;
- is designed to deceive or defraud customers.
Our payment processor has its own list of businesses it won’t support, and it applies to your shop too. We may remove anything we reasonably believe breaks these terms.
Selling to your customers
You are the seller in every sale. Tinbird provides the shop and the checkout, but isn’t part of the sale itself. That means you are responsible for:
- your product descriptions, photos and prices;
- delivery, returns, refunds and customer service;
- following the consumer, privacy, tax and product safety laws that apply to you and your customers.
Payments
Payments are processed by Stripe. To take payments, you connect a Stripe account and accept Stripe’s own terms. Stripe pays your sales into your bank account, and charges its own fees on each payment. Tinbird doesn’t hold your funds and isn’t responsible for Stripe’s service.
Subscription
- Tinbird is a paid subscription. Prices, trials and any fees are as shown on our pricing page or in the app when you subscribe.
- Your subscription renews automatically until you cancel. You can cancel at any time, and it runs to the end of the period you have paid for. We don’t refund partial periods, except where the law requires it.
- Prices don’t include taxes, which may be added where they apply.
- We may change our prices. If a change affects your subscription, we will tell you before it applies.
- If your subscription ends, we may limit your shop, for example by turning off checkout until you subscribe again.
Referrals and promotions
We may offer referral programmes, credit or other promotions. Each has its own rules, which we publish with it. Credit has no cash value and can’t be transferred. We may change or end a programme at any time, and cancel rewards we reasonably believe were gained unfairly.
Your content
Your products, photos and words stay yours. You give us permission to store, copy, adapt and display them as needed to run your shop and provide Tinbird. You confirm you have the rights to give us that permission. It ends when you delete the content or close your account, apart from copies we keep for records such as past orders, or for a limited time in backups.
Suggestions and automation
Some features may suggest product descriptions, prices or other details, including with the help of AI. Suggestions can be wrong, so check them before you publish. What appears in your shop is your responsibility.
Closing your shop
You can close your account whenever you like. We may suspend or close a shop that breaks these terms or puts Tinbird, its users or others at risk. Where it’s reasonable, we will tell you why and give you a chance to put it right first.
The service
We work hard to keep Tinbird running and your data safe, but Tinbird is provided “as is”. To the extent the law allows, we make no promises that it will always be available, free of errors or suited to your purpose. We will keep improving Tinbird, and may change or remove features.
Liability
To the extent the law allows, Tinbird isn’t liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to Tinbird is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that the law says can’t be limited.
You agree to cover Tinbird’s losses from claims by others that arise from your shop, your products, your content or your breach of these terms.
Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, and disputes go to the courts of British Columbia.
Changes to these terms
We may update these terms from time to time. If a change materially affects you, we will let you know in advance, for example by email or in the app. If you keep using Tinbird after a change takes effect, the new terms apply.
General
These terms, and any rules we publish for particular features, are the whole agreement between you and Tinbird. If part of them can’t be enforced, the rest still applies. If we don’t enforce a term straight away, we can still enforce it later.
